The rights of the parties arise under a policy of public liability insurance issued by the company, hereinafter sometimes called the defendant. The plaintiffs seek to charge the company with the duty of defending a suit brought against them by the administrator for the death of his intestate. The deceased, a minor, was fatally injured by the plaintiffs horses on October 10, 1936, while the policy was in full force.
